Terms Of Service - Website Hosting Accounts

AEL Services reserves the right to suspend or cancel any customer's access to any or all services provided by AEL Services at its own discretion, particularly when AEL Services decides that the account has been inappropriately used or otherwise.

ACCOUNT USE

Personal accounts are to be used by the primary owner only, account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

AEL Services reserves the right to refuse web hosting services to anyone at its own discretion.

AEL Services does not allow any of the following content to be stored on customer accounts or sent from any customer accounts under any circumstances.

- Illegal Material - This includes copyrighted works, commercial audio, video, or music files, pirated software, ROMS, emulators, freaking, hacking, password cracking, IP spoofing, etc. Also includes any sites which provide "links to" or "how to" information about such material as well as any material in violation of any Federal, State or Local regulation.

- SPAM and Unsolicited Commercial Email (UCE) - AEL Services takes a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE) or SPAM using our services. Very simply this means that customers of AEL Services may not use or permit others to use any of AEL Services provided facilities to transact in UCE. Customers of AEL Services may not host, or permit hosting of, sites or information that is advertised by UCE from other networks. Violations of this policy carry severe penalties, including termination of service.

1.. Violation of AEL Services SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, AEL Services will initiate an immediate investigation (within 72 hours of notification). During the investigation, AEL Services may restrict customer access to their account to prevent further violations. If a customer is found to be in violation of our SPAM policy, AEL Services may, at its sole discretion, restrict, suspend or terminate customer's account.

2.. First violations of this policy will result in an "Administrative Fee" of $100 and your account will be reviewed for possible immediate termination. A second violation will result in an "Administrative Fee" of $300 and immediate termination of your account. Users who violate this policy agree that in addition to these "Administrative" penalties, they will pay "Research Fees" not to exceed $66 per hour that AEL Services must spend to investigate the matter. PLEASE, DO NOT SPAM from your account.

PAYMENT POLICIES

All accounts are set up on a prepay basis. Although AEL Services reserves the right to change any of its prices of services and so on at any time all pricing is guaranteed for the period of prepayment, being a monthly, quarterly or yearly subscriptions.

Payment is due each anniversary month, quarter or year following the date the account was established.

Customers will automatically be charged again at the end of their prepay period, if the customer requested; otherwise an invoice will be issued.

In situations where the card number on file is declined AEL Services will immediately contact the client to inform them of the situation, if the account is not paid in full or an agreement made between AEL Services and the client within seven (7) days; the immediate suspension of services provided will occur until the outstanding charge is processed successfully.

In addition, AEL Services reserves the right to charge a 'reactivation fee' of $33 whenever a previously deactivated account is reactivated.

No bills or invoices will be sent by regular mail, unless the customer has requested so. All invoices will be sent directly to customers via e-mail shortly after the online purchase has been made. At this point the customer's card will be charged automatically if paying by credit card otherwise an invoice will be issued.

PAYMENT OPTIONS

In order to streamline our accounting procedures and keep costs down AEL Services accepts Visa, MasterCard and PayPal and derivatives of those brands.

In addition to online money transfer payments in Australia only, and cheque to clients who request to pay by cheque and are approved.

CANCELLATION AND REFUNDS

AEL Services reserves the right to cancel the service at any time. Customer refund requests are to be sent via the contact form here and will only be processed on a case by case basis at the sole discretion of AEL Services, Refund requests will be refused if it's requested for any cause that's out of AEL Services control, For example:
- Domain name server address failure/error causes be client or domain register.
- Client cancellation of hosting account mid way throughout billing period.
- Failure of any third party programs that's not supported by AEL Services

REFUND POLICY

Each of AEL Services web hosting plans come with a 30 day money back guarantee. If you are not completely satisfied with our services within the first 30 days of your contract, you will be given a refund of the contract amount excluding setup fees (if any) and overages.

Refund Policy for Renewals
Renewals of web hosting contracts will be refunded if AEL Services is notified within the first 30 days following renewal date. No refunds will be granted for notifications received after this date.

INDEMNIFICATION

Customer agrees that it shall defend, indemnify, save and hold AEL Services harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against AEL Services. Customer agrees to defend, indemnify and hold harmless AEL Services against liabilities arising out of:

(1) any injury to person or property caused by any products and/or services sold or otherwise distributed in connection with services provided by AEL Services.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from AEL Services.

AEL Services will not be responsible for any damages you or your business may suffer, AEL Services makes no warranties of any kind, expressed or implied for services it provides.

AEL Services reserves the right to revise the above policies and terms of service at any time.
